WCAT award 2009-03000 (November 18, 2009)
The union successfully challenged the 2002 legislative changes and the WCB practice directive that the threshold for a Loss of Earnings pension should be 25%. The worker is a LDB merchandise clerk who was injured after the 2002 changes to the WCB legislation. The worker was not able to perform her clerk position but was trained and placed through the Joint Rehab. Committee into a receptionist position. The difference in her loss of earnings was approximately 13%. The union argued and the Vice-Chair agreed that the 13% difference was a significant financial loss and allowed the appeal for a Loss of Earnings pension assessment. This is a significant win for the worker and will assist the Union to argue for better outcomes for other workers' loss of earnings appeals.

BCGEU and Fraserview Community Services - June 5, 2008 (WCB Appeal)

The member was a residential care worker who was injured on the job in 2004. The union has filed many appeals since 2004 fighting for recognition of his physical and psychological injuries. On June 5, 2008, the WCB issued a decision letter stating his permanent functional impairment award would be 46.78% and he will receive a 100% loss of earnings award. This is the first 100% loss of earnings award for any BCGEU member since the Liberal legislative changes in 2002.
