The union argued there was no proper cause and the choice of the six employees laid off by the Employer at Starlight Casino breached Sections 6, 8 and 9 of the Code. The Board rejected the employer's argument the layoffs were bona fide and due to primarily economic factors. The Board found in favour of the union. There was no proper cause for the layoff as a review of the personnel file records did not support the employer's position. The employees were reinstated and the application for remedial certification was denied.
