
REST PERIODS
As a result of grievances previously filed, a Memorandum of Understanding was signed recording an agreement between the Union and the Employer as to the application of rest periods in the Corrections Branch. It was agreed that rest periods would be applied
as follows:
- Secure Institutions
Security posts (i.e. secure living units and control) which require continuous uninterrupted surveillance will receive 15 minute breaks away from their work stations for the rest periods - Hospital Surveillance
As in (1) above, with the exception that where relief cannot be provided, employees may bank the time at straight time rates. The scheduling of such banked time shall be by mutual agreement.
Since 1985, Correction Branch employees have received the benefits as described above. Therefore, the recent Employer communication to our members saying that missed rest periods will no longer be compensated at banked time, is in violation of the collective agreement. Some members have filed grievances and we are proceeding to arbitration.
If you are currently being denied your rest period and do not receive banked CTO/ETO or compensation for the missed rest period, you should continue to file grievances and record all such instances.
