Grievance Filed on Stat Holiday Rate of Pay - Hard Rock Casino - BCGEU


The Union has filed a grievance on behalf of all members that worked on the August 6th statutory holiday.

The Employer and the Union have been unable to reach an agreement on the meaning of Clause 18.2 d):

An employee who is scheduled by the Employer to work on a statutory holiday shall be paid one and one-half times their wage rate for any hours worked on the statutory holiday, in addition to the payment provided for in ( c ) above.

The Union's position is that everyone working the statutory holiday is to be paid at the rate of one and one-half wage rate, regardless of the number of days they worked prior to the stat holiday.

The Employer has agreed that if a remedy is achieved at arbitration, it will apply to all stat holidays on a go-forward basis. That means additional grievances on the same matter do not need to be filed each statutory holiday. This grievance only applies to 18.2 (d) when a worker has worked on the stat holiday.
