How To Grieve Discipline - Hard Rock Casino - BCGEU

With your collective agreement, there is now a formal process to solve problems or disagreements about discipline. This is called the grievance procedure and you can find it in Article 7 of the collective agreement.

You have the right to have a steward present whenever you are receiving discipline of any kind from the Employer (as per Article 9.1)

If you receive discipline that you believe is unfair or excessive follow these steps:

Grievance Procedure

  1. First you need to email or write to your direct manager within 4 days of getting the discipline, to let them know you want to grieve it. Ask for a Step 1 meeting.
  2. After this email, you and your direct manager must meet within 14 days to discuss the issue. At this meeting, you both need to try your best to solve the problem or issue and come to an agreement to resolve it. Bring a steward with you. It is your responsibility to ask for a steward for this meeting. Do not let the 14 days go by – keep asking for the meeting until you get one and contact a steward.
  3. If you, the manager, and the steward can't come to an agreement to resolve the problem you can fill out a BCGEU Grievance Form with your steward within 10 days of the Step 1 meeting.
  4. This grievance then goes to the Union Staff Rep, who handle it from there. The Union and your steward may contact you to ask questions about your grievance, and might ask for evidence.
  5. The Union and the Employer will do their best to come to a fair agreement regarding your issue, by looking at what happened, as well as the law and the collective agreement.
  6. If the Union and Employer can't come to an agreement and the grievance has merit, the Union can file the grievance to arbitration. At arbitration, a neutral, third party arbitrator will hear from both sides and make a decision on what should be done. This decision will be binding on both sides, and will be based on the law and the collective agreement.

It is your right to file a grievance if the Collective Agreement is violated or if you receive unfair discipline. Stewards are here to help you.
