Members at Protrans BC Operations Ltd. Re: Compass Card MOA & Shift Vacancy MOA


The Union has concluded negotiations on two Memorandum’s of Agreement (MOA’s) regarding two separate issues at Protrans. Both of these MOA’s expire with the current collective agreement and were negotiated in consultation with your members of the Joint Committee. 

This creates certainty until the current agreement expires and allows the parties to negotiate solutions more thoroughly at that time. Copies of the MOA are attached to this FYI and available on the website.

Compass Card MOA

The implementation of ‘Fare Gates’ created uncertainty regarding the use of compass cards under Letter of Understanding #3 in the agreement.

The parties have agreed that members in eligible classifications are to use these cards to carry out their duties on a regular basis and is in fact a work tool. Therefore, the Employer has agreed to waive replacement fees as long as members haven’t lost one within two years.

The MOA does apply to all members that have lost a compass card since the installation of the ‘Fare Gates’

Shift Vacancy MOA

The parties found themselves in a disagreement over entitlements under Article 15.4 (j) of the collective agreement. Although the Employer had informally offered more desirable shifts that became available during the shift year on the basis of seniority, they asserted it was not something they were compelled to do under the terms of the agreement. The Union’s review of the language and bargaining history revealed some challenges in asserting that practice had to continue.

The parties were able to reach an agreement through the current collective agreement that allows the offering of vacancies that arise during the shift year, but limits the ‘domino’ effect that can occur as a result.
