TMA grievances on deck with Arbitrator - BCGEU


On November 15 and 16, the bulk of the outstanding Temporary Market Adjustment (TMA) grievances will be the subject of a hearing in front of Arbitrator David McPhillips.

The grievances arise pursuant to both the Master Memorandum of Agreement #22, the Correctional and Sheriffs Services Memorandum of Understanding dated September 16, 2008, and Articles 27.4 and 27.5 of the Master Agreement.

Witnesses from both Corrections and Sheriffs Services will be attending to give evidence at the hearing.

In addition, representatives from the Component executive will also be in attendance to observe the proceedings.

As a condition of his appointment, McPhillips must make a decision within 60 days of the hearing, so we expect a fairly quick resolution of the issue.

There are other TMA grievances that are similar in principle, but have different facts associated with them. The hearing on November 15 and 16 could impact these grievances, but we won't know that until the Arbitrator renders his decision.

Individual grievors will be kept apprised of both the outcome of their particular grievance and the impact of any arbitral decision on outstanding grievances.
